News on leaves and health insurance indemnities

Law no. 183/2015 for the approval of Government Emergency Ordinance no. 36/2010 for the amendment and completion of the Government Emergency Ordinance no. 158/2005 regarding leaves and health insurance indemnities was published within the Official Gazette no. 496 from July 7, 2015.

According to the new legal provisions, in order to benefit from leaves and health insurance indemnities, during the leave period the employees are no longer required to be at their domicile or indicated address for the control made by the representatives of health insurance indemnities payers.

Also, according to the new legal provisions, the payers of health insurance indemnities have no longer the possibility to check the presence of the insured person who is on medical leave at their domicile or indicated residence. As a consequence, the implementing rules of this provision will no longer be enforceable.

Consequently, the refusal of the employee to be subject to such a control, will no longer trigger the cease of the health insurance indemnities.
