Law no. 178/2010 concerning the Public-Private Partnership (the “PPP Law”) has been published in the Official Gazette no. 676 of 5 October 2010 and will come into force in 30 days from publication (4 November 2010). This note attempts to give the reader a brief overview of (i) the legislative process and key steps to follow and (ii) the key features of the new legislation of interest for investors in PPP projects.

Law 161/2010 amending Art. 84 of Law 296/2004 on the Consumer Code and Law 193/2000 on the abusive clauses of the contracts concluded between traders and consumers (“Law 161/2010”) was published in the Official Gazette no. 497 dated July 19, 2010.
Construction and building permitting related enactments
Within Official Gazette no. 347 dated 26 May 2010 it was published the Decision of the National Authority for Management and Regulation in Communications (“ANCOM”) no. 338 dated May 4, 2010, related to the new general authorisation regime for the electronic communications providers (hereinafter „Decision no. 338/2010”).
Decision no. 226/2010 issued by the National Authority for Management and Regulation in Communications of Romania (“ANCOM”) amending and supplementing the Decision of the president of the General Inspectorate for Communications and Information Technology no. 660/2005 on the approval of the Radio Communication Regulation of for the Amateur Service in Romania (hereinafter referred to as “Decision no. 226/2010”) was published in the Official Gazette no. 2235 as of April 14, 2010.

The Decision of the President of the National Authority for Management and Regulation in Communications (hereinafter referred to as “ANCOM”) no. 54/2010 for the amendment and supplementation of the Regulation of the military staff operating the Romanian radio-communications stations (“Decision 54/2010”) was published in the Official Gazette no. 80 dated February 5, 2010.
