30.03.2022 – The public procurement and transport infrastructure legislation has been recently amended following the entry into force of two normative acts at Government level, approved in the Government meeting of March 18, 2022

Law no. 178/2010 concerning the Public-Private Partnership (the “PPP Law”) has been recently amended via the Emergency Governmental Ordinance no. 39/2011, published in the Official Gazette no. 284/21.04.2011 (“EGO 39/2011”).

The Romanian Government decided on April 27, 2011, that a number of infrastructure projects be structured as public-private partnerships, for reasons including the magnitude or complexity thereof.

Law no. 178/2010 concerning the Public-Private Partnership (the “PPP Law”) has been published in the Official Gazette no. 676 of 5 October 2010 and will come into force in 30 days from publication (4 November 2010). This note attempts to give the reader a brief overview of (i) the legislative process and key steps to follow and (ii) the key features of the new legislation of interest for investors in PPP projects.
