News on employers’ obligation to notify occupied vacant positions

Law no. 250/2013 for the amendment of Law no. 76/2002 on unemployment has been published within the Official Gazette no. 457 dated July 24, 2013.

The new legal provisions set forth an additional obligation for employers as regards the vacant positions. Thus, employers will be required to notify to the local unemployment agencies the vacant positions, prior communicated under the law, that were occupied. Such communication must occur within a day, starting as of the date of their occupancy.

Failure to comply with such provisions represents an administrative offense carrying fines from RON 3.000 to 5.000 (approx. from EUR 650 to 1.100).

The new obligation will be mandatory starting October 22, 2013.

Furthermore, Law no. 250/2013 for the amendment of Law no. 76/2002 on unemployment also brings other changes that will apply starting October 22, 2013, such as amendments on the termination and suspension of unemployment allowance payment, unemployment benefits or small and medium sized enterprises’ benefits.
