NNDKP Assists Azvi/Ascale and Facilitates the Rehabilitation of DN 76 Stei – Beius

The Bucharest Court of Appeals admitted the claim filed by the Joint Venture Azvi/Ascale Constructie, represented by Nestor Nestor Diculescu Kingston Petersen and consequently obtained a decision imposing the Romanian National Company for Highways and National Roads (CNADNR) to sign the contract for the rehabilitation of DN 76 Stei – Beius.

NNDKP assisted and represented Azvi/Ascale Constructie both in court and in the administrative proceeding before the National Council for Solving Complaints (CNSC), which resulted in a decision ordering the authority to sign the public procurement contract. The contracting authority had annulled the procedure two years after announcing the successful tender, after avoiding the execution of the contract throughout this entire period.

“The solution of the Bucharest Court of Appeals confirms the initial result of the public tender held during 2008-2009 and at the same time creates the precedent whereby an authority is obligated pursuant to a judicial decision to sign a public procurement contract. This decision is the result of the compelling legal arguments arising out of the joint effort of NNDKP’s litigation and public procurement teams, coordinated by partners Adina Chilim-Dumitriu (public procurement) and Radu Damaschin (dispute resolution)”, states Ana Diculescu-Sova, senior partner and head of the dispute resolution department.
