Product recall

We assist our clients in order to plan and conduct product recall actions, including through RAPEX system and also by drafting and / or reviewing relevant documentation. We also represent our clients before the National Authority for Consumers Protection prior to and during the product recall actions.

Product Safety / Product Liability

We provide legal guidance in product safety and product liability regulatory matters, clarification requests addressed to the National Authority for Consumers Protection with respect to all consumer protection aspects and further discussions and representation of the clients before this authority.

Labeling

We provide legal guidance in all regulatory labeling matters for clients from various business fields (e.g. food sector, software, tobacco, clothing, etc.), including review and clearance of labeling and language instructions for the products/services placed on the Romanian market.

Warranty

We advise our clients with respect to regulatory matters regarding the obligation of conformity and warranty. We also revise our clients’ warranty certificates, declarations and advertising materials for compliance with the warranty legislation in force.

Promotional activities

We provide extensive legal guidance and review the compliance of advertising materials and promotional schemes with the legislation in force in various business fields, e.g., tobacco, beer, spirits, software, electronic devices, vehicles, food supplements, etc.

We assist clients in structuring the promotional mechanisms in order to avoid the qualification thereof as infringing any legal provisions in force or as a prohibited practice in Romania.

Distance contracts

We advise our clients regarding the legal framework for concluding distance contracts and provide legal guidance on the legal rights and obligations of the parties. We also perform legal reviews of Terms and Conditions and agreements governing the use of different websites as well as of different statements to be posted by the clients on their websites.

Abusive clauses

We provide legal guidance and assist clients in structuring the contractual clauses that might be considered as abusive in their relationship with Romanian consumers.

Food law

We provide extensive legal assistance to clients in different food sectors, including food supplements, regarding various regulatory matters and representation of the clients before the competent authorities. We assist clients in restructuring different promotional mechanisms in order for such not to be qualified as prohibited practices in Romania.

Credit contracts

We have assisted several banks in relation to the implementation of the legal provisions concerning credit contracts for consumers.
