Competition

The Competition practice has developed as a highly specialized practice within our firm for over thirteen years, since the entry into force of the Romanian Competition Law and the establishment of the competition authority.

Our team offers in-depth and innovative advice in a wide array of complex competition matters to both local and foreign clients in structuring transactions and operations to meet the requirements of Romanian and EU competition legislation and in defending or obtaining clearance for their business conduct.

Our team has broad experience in dealing with the entire range of competition matters.

We create defense strategies and draft statements of defense in response to the competition authority’s statements of objections, and we represent the clients at hearings during the Competition Council’s investigations. We assist clients during dawn raids, following which we prepare risk assessments and recommend the course of action. We assist clients in notification procedures, we perform the initial assessment as to whether notification is necessary, we draft and file economic concentration notification forms and requests for individual exemption or for precursory certification of non-intervention by the Competition Council, and we represent the clients in the proceedings until obtaining clearance decisions. We perform competition audits and prepare adequate recommendations in consideration of the risks identified, and we provide specialized competition training for the clients.

Coordinated by Senior Associate Georgeta Harapcea, the Competition practice team has an expertise combining knowledge obtained at some of the most prestigious European Universities with extensive experience in dealing with the competition authorities. The practice is highly appreciated by Chambers Europe, 2009 edition, for the “high-quality output, strong communication skills and efficient and timely work.”
